Terms of Services

These Terms of Service (“Terms”) govern your access to and use of the website atiqandjade.ae and your purchase of products from AtiQ & Jade (“AtiQ & Jade”, “we”, “us”, “our”). AtiQ & Jade is the trading name of Zant Zetoyn Accessories L.L.C.O.P.C, a business licensed in the United Arab Emirates, with its registered address at Gate Tower, Al Reem Island, Abu Dhabi, United Arab Emirates. AtiQ & Jade is powered by Shopify, which enables us to provide our store and services (the “Services”) to you.

By accessing this website or placing an order, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Returns & Exchange Policy and Shipping Policy, each of which is incorporated into these Terms by reference. If you do not agree, please do not use the Services.

These Terms are governed by the laws of the United Arab Emirates, including Federal Law No. 15 of 2020 on Consumer Protection and its Executive Regulations, Federal Decree-Law No. 14 of 2023 on Trading by Modern Technological Means, and Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.

1. Eligibility and Access

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to place an order. By using the Services, you represent that you meet these requirements and that all information you provide is accurate, current and complete, and that you have all rights necessary to provide it.

2. Your Account

You may browse and purchase as a guest or by creating an account. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You may not transfer, sell, assign or license your account to any other person. Please notify us immediately at Support@atiqandjade.ae if you suspect unauthorised use. We may suspend or close any account in cases of suspected fraud, misuse or breach of these Terms.

3. Our Products and Natural Variation

AtiQ & Jade offers Mesbah beads (cultural and meditative objects), gemstone jewellery, leather bracelets, silver signature pieces and related items.

Our pieces are made from natural and semi-natural materials. Gemstones, beads, leather and metals vary naturally in colour, grain, veining, inclusions, weight and finish. Slight variation between the item you receive and the images shown is inherent to natural materials and is not a defect. Product images are intended as a faithful representation only; actual colour and appearance may differ depending on your screen, lighting and photography. Measurements are approximate and may carry minor tolerances consistent with hand-finished work.

We take care to describe and depict each piece accurately, in line with our obligations under UAE law. All product descriptions are subject to change without notice, and we may discontinue any product or limit quantities offered to any person or region at our discretion. Where a product is genuinely defective, your statutory rights under the UAE Consumer Protection Law are not affected (see Section 9).

4. Orders and Acceptance

When you place an order, you are making an offer to purchase. A contract is formed only when we confirm acceptance of your order, normally when the order is dispatched. We reserve the right to refuse, limit or cancel any order — including for reasons of suspected fraud, stock unavailability, pricing error, or failure to meet these Terms — and will refund any amount already charged for an order we are unable to fulfil. If we cancel or change an order, we will attempt to notify you using the email, billing address or phone number provided at the time of the order. Please review your order carefully before submitting, as we may be unable to accommodate changes after an order is accepted.

5. Pricing, Currency and Taxes

All prices are displayed in UAE Dirhams (AED). The displayed price is the final price for the product, with no further taxes or charges added to it. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation. Any shipping charge that applies is shown separately at checkout before you confirm your order.

Prices, discounts, promotions and availability may change at any time without notice. Promotions may be governed by their own terms; where those conflict with these Terms, the promotion terms govern. While we make every effort to ensure pricing is accurate, errors may occur. If we discover a pricing error on an item you have ordered, we will contact you before dispatch and give you the option to confirm the order at the correct price or cancel it for a full refund. We are not obliged to supply a product at an incorrect price.

6. Payment

We accept the payment methods displayed at checkout, which may include credit and debit cards, Apple Pay, Google Pay, and Tabby (Buy Now, Pay Later). Payments are processed securely by third-party payment providers, and your use of those services may be subject to their own terms. We do not store full card details, and we do not impose any additional fee on you for choosing a particular digital payment method. You represent that you are authorised to use the payment method you provide and that the information given is true, correct and complete.

7. Shipping and Delivery

We ship within the United Arab Emirates, with international delivery available by inquiry. Delivery timeframes, charges and thresholds are set out in our Shipping Policy. Delivery times are estimates only and are not guaranteed. Risk in the products passes to you on delivery. We are not liable for delays caused by carriers, customs, incorrect address details, or events beyond our reasonable control.

8. Returns, Exchanges and Cancellations

Returns and exchanges are handled in accordance with our Returns & Exchange Policy, which forms part of these Terms. You represent that your purchases are for your own personal or household use and not for commercial resale or export. Nothing in that policy or these Terms removes or reduces any non-excludable right you have as a consumer under UAE law, including the right to a remedy for goods that are defective or not as described.

9. Consumer Rights

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the UAE Consumer Protection Law (Federal Law No. 15 of 2020) or Federal Decree-Law No. 14 of 2023, where such rights cannot lawfully be excluded. Where there is any conflict between these Terms and your non-excludable statutory rights, those statutory rights prevail.

10. Intellectual Property

All content on this website — including the AtiQ & Jade name, the Arabic calligraphy logo, product and lifestyle photography, graphics, text, designs, the layout and arrangement of the site, and the heritage narrative relating to our Damascus origins of 1931 — is owned by or licensed to AtiQ & Jade and is protected by UAE and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not copy, reproduce, republish, distribute, modify, create derivative works of, scrape, frame, download, store or transmit any part of the Services or our content for commercial purposes without our prior written consent. The AtiQ & Jade name, logo, product and service names, designs and signatures are our trademarks and brand assets and may not be used without authorisation. Shopify's name, logo and marks are trademarks of Shopify. All other marks are the property of their respective owners. All rights not expressly granted are reserved.

11. Acceptable Use

You may access and use the Services for lawful purposes only. You agree not to use the Services, directly or indirectly: for any unlawful or malicious purpose; to violate any applicable law or regulation; to infringe the intellectual property or other rights of any person; to harass, abuse, defame or harm any person, including our staff; to transmit false or misleading information; to send unsolicited advertising or spam; to impersonate any person or entity; to upload viruses or malicious code; to collect or track the personal information of others; or to use any robot, spider, scraper, data-extraction tool, or automated means to access the Services, or to bypass any security or access-control measure. We may suspend, disable or terminate access for any breach.

12. Reviews and Submitted Content

If you submit a review, photograph, comment, idea or other content (“Feedback”), you confirm that it is your own, lawful and accurate, and that it does not infringe the rights of any third party. You grant us a perpetual, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium in connection with our brand and the Services, including for marketing. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it, and we may moderate, edit or remove any Feedback at our discretion. You may not use a false identity or mislead us or others as to the origin of any Feedback.

13. Optional Third-Party Tools

You may be provided with access to third-party tools as part of the Services, which we neither monitor nor control. We provide access to such tools “as is” and “as available” without any warranties, representations or endorsement, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk, and you should familiarise yourself with, and approve of, the terms on which they are provided by the relevant third party. New features or tools added in the future also form part of the Services and are subject to these Terms.

14. Third-Party Services and Links

The Services may contain links to, and integrations with, websites and services operated by third parties (for example, payment providers such as Tabby, and our social media channels). We are not responsible for examining or evaluating, and are not liable for, the content, accuracy, products, services or practices of any third party. If you access third-party materials or sites, you do so at your own risk and subject to their terms and privacy policies. Complaints regarding third-party products or services should be directed to the relevant third party.

15. Relationship with Shopify

AtiQ & Jade is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with AtiQ & Jade. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and AtiQ & Jade, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with AtiQ & Jade.

16. Automated Agents and AI

This Section applies if you use, enable or cause the deployment of an Agent to access or interact with the Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity without direct human supervision.

No Agent may access or interact with the Services unless it identifies itself as an Agent and discloses its name in the user-agent string of all HTTP/HTTPS requests (for example, “Agent/[name]”), and unless it operates truthfully and transparently. Agents must not conceal that interactions originate from an Agent, must not mimic human behaviour to evade detection, must not circumvent CAPTCHAs or other measures intended to distinguish humans from computers, and must not bypass any measure we use to block, limit or control automated access. We may restrict, by technical or other means, whether and how any Agent accesses the Services, and may require any Agent to refrain from accessing the Services.

17. Errors, Inaccuracies and Omissions

Occasionally there may be information in the Services containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any such errors and to change or update information, or cancel affected orders, at any time without prior notice, including after an order has been submitted.

18. Disclaimer of Warranties

The Services and all products offered through them are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not warrant that the Services will be uninterrupted, timely, secure or error-free, and we do not guarantee the accuracy or completeness of information made available for general information purposes. Nothing in this Section affects your statutory rights, or any warranty or condition that cannot be excluded under UAE law.

19. Limitation of Liability

To the fullest extent permitted by UAE law, the total liability of AtiQ & Jade arising out of or in connection with any order or your use of the Services shall not exceed the amount you paid for the relevant order. We shall not be liable for any indirect, incidental, special, punitive or consequential loss, including lost profits, lost revenue, lost data or replacement costs. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded or limited under UAE law, including your non-excludable rights under the UAE Consumer Protection Law.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless AtiQ & Jade and its officers, employees, agents, contractors and licensors from any losses, damages, liabilities and reasonable costs arising out of your breach of these Terms or the documents they incorporate, your violation of any law or the rights of a third party, or your misuse of the Services.

21. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, severe weather, fire, war, civil unrest, strikes, failures of carriers or suppliers, internet or power outages, or governmental action.

22. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy and Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data. Because the Services are hosted by Shopify, information you submit may be transmitted to and processed by Shopify and its sub-processors, which may be located outside the UAE, in order to provide the Services. We will not use your personal data for marketing without a lawful basis, and you may opt out of marketing communications at any time. Please review our Privacy Policy for full details.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or the law. The most current version is always available on this page, and the version in effect when you place an order applies to that order. We will notify you of material changes in accordance with applicable law. Your continued use of the Services after changes are posted constitutes acceptance of those changes.

24. Termination

We may terminate or suspend your access to the Services at our discretion, with or without notice, including for any breach of these Terms, and you will remain liable for all amounts due up to the date of termination. The Sections concerning Intellectual Property, Reviews and Submitted Content, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any provisions that by their nature should survive, will continue to apply after termination.

25. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or in connection with them or your use of the Services, are governed by the federal laws of the United Arab Emirates and the applicable laws of the Emirate of Abu Dhabi. The courts of Abu Dhabi shall have jurisdiction, without prejudice to any non-excludable right you may have to bring proceedings before another competent UAE court.

26. General

If any provision of these Terms is found to be unlawful, void or unenforceable, it shall be severed and the remaining provisions shall continue in full force. Our failure to enforce any right or provision does not constitute a waiver of it. You may not assign or transfer these Terms without our prior written consent; we may assign them without restriction. Headings are for convenience only. These Terms, together with the policies referenced in them, constitute the entire agreement between you and AtiQ & Jade regarding your use of the Services and supersede any prior agreements. Any ambiguity shall not be construed against the drafting party.
